1. Acceptance of Terms

By downloading, installing, or using the Kefir application ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you") and the developer of Kefir ("we", "us", "our").

2. Description of Service

Kefir is a gut health tracking mobile application that allows users to:

• Log meals and receive AI-powered gut health scores.
• Track hydration, fiber intake, and nutritional patterns.
• Monitor progress over time through charts and statistics.
• Discover and save gut-friendly recipes.
• Receive personalized dietary insights.

Kefir is available on Android via Google Play and on iOS via the Apple App Store.

3. Eligibility

You must be at least 16 years of age to use Kefir. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian.

4. Subscriptions and Payments

4.1 Free Trial

Kefir offers a 3-day free trial for new users. The trial begins upon confirmation of subscription through Google Play or the Apple App Store. No charge is made during the trial period.

4.2 Paid Plans

After the free trial, access to Kefir requires a paid subscription:

• Monthly plan: $8.00 per month
• Annual plan: $59.00 per year

Prices may vary by region and are displayed in your local currency at checkout.

4.3 Billing

Subscriptions are billed through Google Play on Android or the Apple App Store on iOS, and managed via RevenueCat. Your payment method will be charged automatically at the end of the free trial and at each renewal period unless cancelled beforehand.

4.4 Cancellation

You may cancel your subscription at any time through Google Play settings (Android) or your Apple ID subscription settings (iOS). Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused periods, except where required by applicable law.

4.5 Refunds

Refund requests are handled in accordance with Google Play's refund policy (Android) or Apple's refund policy (iOS). We do not process refunds directly. To request a refund, visit your Google Play or Apple App Store account.

4.6 Price Changes

We reserve the right to change subscription prices. We will notify you at least 30 days in advance of any price changes. Continued use of the App after a price change constitutes acceptance of the new pricing.

5. User Account

5.1 Anonymous Authentication

Kefir uses anonymous authentication — you do not need to create an account with an email or password. A unique anonymous ID is generated automatically on first launch and is used to store your data securely.

5.2 Data Responsibility

You are responsible for the accuracy of the information you input into the App (meal names, serving sizes, etc.). Kefir cannot verify the accuracy of user-submitted data.

5.3 Account Termination

We reserve the right to suspend or terminate access to the App if you violate these Terms or use the App in a manner that is fraudulent, abusive, or harmful.

6. Health Disclaimer

IMPORTANT: Kefir is not a medical application.

• The gut health scores, nutritional information, and AI-generated insights provided by Kefir are for informational and educational purposes only.
• Kefir is not a substitute for professional medical advice, diagnosis, or treatment.
• Always consult a qualified healthcare professional before making significant changes to your diet, especially if you have a medical condition (including but not limited to IBS, Crohn's disease, celiac disease, diabetes, or eating disorders).
• We do not guarantee the accuracy, completeness, or suitability of any nutritional information provided by the App.
• Reliance on any information provided by Kefir is solely at your own risk.

7. AI-Generated Content

Kefir uses Google Gemini AI to analyze meals and generate health scores and recommendations. By using these features, you acknowledge that:

• AI-generated scores and recommendations are estimates based on general nutritional knowledge and are not personalized medical advice.
• AI analysis may contain errors or inaccuracies.
• The AI cannot account for individual health conditions, allergies, intolerances, or medications.
• We are not liable for any decisions made based on AI-generated content.

8. Intellectual Property

8.1 Our Content

All content within the App — including but not limited to the Kefir name, logo, mascot, design, recipes, text, graphics, and software — is owned by or licensed to us and is protected by applicable intellectual property laws.

8.2 Your Content

You retain ownership of any content you create within the App (meal logs, custom recipes, photos). By uploading content to the App, you grant us a limited, non-exclusive, royalty-free license to store and process that content solely for the purpose of providing the App's features.

8.3 Restrictions

You may not:

• Copy, modify, distribute, or reverse engineer any part of the App.
• Use the App's content for commercial purposes without our express written consent.
• Attempt to extract or scrape data from the App.

9. Prohibited Use

You agree not to use Kefir to:

• Violate any applicable law or regulation.
• Upload harmful, offensive, or illegal content.
• Attempt to gain unauthorized access to any part of the App or its infrastructure.
• Interfere with the proper functioning of the App.
• Use the App for any purpose other than personal, non-commercial use.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• We provide the App "as is" and "as available" without warranties of any kind.
• We do not warrant that the App will be uninterrupted, error-free, or free of viruses.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
• Our total liability to you for any claim arising from these Terms or use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless the developer of Kefir from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Third-Party Services

The App integrates third-party services including Supabase, Google Gemini, RevenueCat, and PostHog. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

13. Availability and Updates

• We reserve the right to modify, suspend, or discontinue the App or any of its features at any time, with or without notice.
• We may release updates to the App. Some updates may be required to continue using the App.
• We do not guarantee that the App will be available at all times or in all regions.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia and the applicable laws of the European Union, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved amicably by contacting us at johnsig76@gmail.com. If not resolved within 30 days, disputes shall be submitted to the competent courts of Estonia.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via a notification. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
